These Terms of Use (“Terms”) constitute a legally binding agreement between you and Educational Apps LLC (“Company,” “we,” “us,” or “our”) governing your use of the Antique Identifier mobile application (the “App”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use the App.

1. Overview and Eligibility

The Antique Identifier App is an educational tool designed to help users identify, learn about, and obtain approximate valuations of antiques, vintage items, and collectibles using image recognition and AI technology.

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use on a compatible device, subject to these Terms.

3. User Accounts

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You may upload or submit photos and images of items (“User Content”) for identification and analysis.

• You retain ownership of your User Content.
• By submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, process, analyze, store, and display your User Content solely for the purpose of providing the App’s services, improving our AI models, and enhancing the App.
• You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights.

5. Prohibited Conduct

You agree not to:

• Use the App for any illegal, fraudulent, or unauthorized purpose.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App.
• Upload content that is infringing, defamatory, obscene, or violates any applicable law.
• Interfere with the operation of the App or its servers.
• Use automated means (bots, scrapers, etc.) to access or collect data from the App without permission.
• Remove or alter any copyright, trademark, or proprietary notices.

6. Intellectual Property

The App, including its design, features, AI models, content, graphics, and logos, are the exclusive property of Educational Apps LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Identification and Valuation Disclaimer

• All identifications, descriptions, historical information, and valuation estimates provided by the App are for educational and informational purposes only.
• Valuations are approximate estimates based on available data and AI analysis. Actual market values can vary significantly depending on condition, rarity, provenance, location, and market conditions.
• We do not guarantee the accuracy, completeness, or reliability of any identification or valuation.
• You should consult qualified professional appraisers or experts for official valuations, authentication, or investment decisions.
• We are not responsible for any financial loss, damage, or other consequences resulting from reliance on information provided by the App.

8. Third-Party Services and Links

The App may integrate with or link to third-party services, websites, or resources. We are not responsible for the content, privacy practices, or availability of such third parties.

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be error-free, uninterrupted, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUCATIONAL APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including attorney’s fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms in the App with an updated effective date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

14. Governing Law
