These Terms of Use (“Terms”) govern your access to and use of the mobile application Equestrian – Horse & Riding Log (the “App”) operated by Educational apps LLC (“we”, “us”, “our”).

By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

5. Safety Tracking and Location Features

The App includes optional Safety Tracking that allows selected contacts to view your real-time location during a ride and receive alerts if movement stops.

Important: Safety Tracking is a convenience feature only. It is not a substitute for professional emergency services, personal judgment, or proper safety equipment and practices. We do not guarantee continuous availability, accuracy of location data, or timely delivery of alerts. Always ride responsibly and follow local safety guidelines.

You retain ownership of content you upload or create in the App (including ride data, photos, horse records, messages and comments) (“User Content”).

By submitting User Content you grant Educational apps LLC a worldwide, non-exclusive, royalty-free, transferable licence to use, store, display, reproduce and distribute that content solely for the purpose of operating and improving the App and providing the services to you and other users (according to your privacy settings).

You represent that you have all necessary rights to the User Content you submit and that it does not violate any third-party rights or applicable law.

We may remove User Content that violates these Terms or that we reasonably believe is harmful or unlawful.

7. Intellectual Property

The App, including its design, software, logos, text, graphics and all related intellectual property, is owned by Educational apps LLC or its licensors and is protected by copyright, trademark and other laws.

You may not copy, modify, distribute, sell or lease any part of the App or reverse-engineer it except as expressly permitted by law or with our prior written consent.

8. Premium Features and Payments

Some features may require a paid subscription. Subscription terms, pricing and renewal details are presented at the time of purchase and are handled through the applicable app store (Apple App Store or Google Play).

All payments are subject to the terms of the relevant app store. Refunds are handled according to the app store’s refund policy. We do not process refunds directly.

9. Third-Party Services

The App may integrate with or link to third-party services (for example sign-in providers or analytics). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or that location data or ride statistics will be accurate or complete. Horse-related records and recommendations are for informational purposes only and do not constitute veterinary, training or professional advice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUCATIONAL APPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.

IN PARTICULAR, WE SHALL NOT BE LIABLE FOR ANY INJURY, LOSS OR DAMAGE ARISING FROM RELIANCE ON SAFETY TRACKING, LOCATION DATA, RIDE STATISTICS OR ANY OTHER FEATURE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases the above limitations apply to the fullest extent permitted by law.

You agree to indemnify and hold harmless Educational apps LLC and its officers, directors, employees and agents from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

13. Termination

You may stop using the App and delete your account at any time.

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or for operational or security reasons.

Upon termination, your right to use the App ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability and indemnification) will survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify you through the App or by email and update the “Last updated” date. Continued use of the App after the changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved amicably. If not resolved, the dispute shall be submitted to the exclusive jurisdiction of the state or federal courts located in Delaware, unless applicable law requires otherwise.
